GENERAL TERMS AND CONDITIONS OF SALE

Application of the General Terms and Conditions of Sale: These General Terms and Conditions of Sale (hereinafter “G.T.C.S.”) apply to the sale of products by Château de Ferrand by mail or by telephone. They are given with the purchase order. Any order constitutes acceptance of the G.T.C.S. in effect.
Our offers are exclusively reserved to private customers, to the exclusion of professional resellers, and are valid within the limit of the time periods indicated and of available stocks. Orders become final only after receipt of full payment by the customer.

Prices: In the commercial offers of Château de Ferrand for private customers, the prices are given in Euros, inclusive of all taxes. They apply throughout the period of validity indicated in the offers. The products are invoiced on the basis of the price in effect at the time of booking the order.

Payment: The price of the items ordered (hereinafter “the Price”) is to be paid in Euros and in full to Château de Ferrand by cheque, wire transfer or credit card (CB, Visa and MasterCard, with indication of the card number, its expiry date and the name of the holder) before any delivery.

Delivery time: Upon receipt of the full payment of the Price by the customer, the products ordered (hereinafter “the Products”) will be shipped within 72 working hours as from receipt of the order.
Should the goods not be delivered within a period of 10 working days after the sending of the order, the customer is requested to inform Château de Ferrand thereof.

Documents accompanying delivery: Delivery of the Product is accompanied by the final invoice detailing the amount of VAT and any carriage costs, by the G.T.C.S and by a standard withdrawal form.

Transfer of risks: The customer becomes fully responsible for the goods delivered as from their material delivery, the transfer of possession entailing the transfer of risks. It is up to the customer to check the weight and contents of the parcel upon arrival and to make the customary reservations for any anomaly in writing at the time of delivery on the form provided by the haulier, and then to advise the Château de Ferrand company by E-mail and by registered letter within acknowledgement of receipt within the 48 hours following receipt of the parcel, failing which the customer shall be considered to have taken full and complete possession of the goods and the concomitant risks. In the event of breakage or damage in the course of delivery, if the proper reservations have been made upon delivery and if Château de Ferrand has been duly advised within the time period indicated hereinabove, a new delivery will be made or the Price will be refunded.

Withdrawal

Withdrawal period: By virtue of Article L.121-17 and L.121-21 of the French Consumer Code, the customer benefits from the right to withdraw from his order, without having to give any grounds therefor, within a period of fourteen days as from the day when the customer, or a third party other than the haulier and appointed by the customer:

  • takes physical possession of the item;
  • takes physical possession of the last item, in the case of several items ordered by means of a single order and if the said items are delivered separately;
  • takes physical possession of the last batch or of the last part, in the case of delivery of an item in several batches or parts;
  • takes physical possession of the first item, in the case of regular delivery of items over a given period of time. The right of withdrawal is exercised by sending notice thereof by E-mail or by fax to:

The decision to withdraw from the present contract is made by a declaration devoid of all ambiguity before the expiry of the withdrawal period. Use of the withdrawal form is not compulsory.
Acknowledgement of the withdrawal will then be promptly by Château de Ferrand on a durable medium (e.g. by E-mail).

Return of the goods: The customer must return or give the Products back to Château de Ferrand at the address given hereinabove without any excessive delay and in any case at the latest within fourteen days after the forwarding of the decision to withdraw from the present contract. That time period is considered to have been observed if the goods are returned before the expiry of the fourteen day period. The customer takes the cost for the return of the Products for his own account.

Effects of withdrawal: In the case of withdrawal and subject to Château de Ferrand having received the Products, the customer will be reimbursed, including the delivery costs (with the exception of any additional costs if the customer has chosen a mode of delivery different from the standard delivery) without any excessive delay and at the latest within eight days as from the day when Château de Ferrand received the Products. The means of payment used for reimbursement will be that indicated by the customer on the withdrawal form or failing that the means used by the customer at the time of payment for the Products.

Guarantee and exclusion: The Products are guaranteed for the use for which they have been produced. Château de Ferrand undertakes to replace any Products recognised as being faulty after analysis thereof by the company in order to record eventual defects (visual, olfactory and gustatory). The Products are to be returned to Château de Ferrand at its address indicated hereinabove.
The costs of the return are for the account of Château de Ferrand.

Force majeure: Performance by Château de Ferrand of its obligations hereunder shall be suspended in the event of the occurrence of any such unforeseeable circumstances or case of force majeure as may hinder or delay such performance. Château de Ferrand will advise the customer of the occurrence of any such unforeseeable circumstances or case of force majeure within the 10 working days as from the date of the occurrence of such an event.

Consumer protection: Alcohol abuse is dangerous to health. Alcohol is to be consumed in moderation. The sale of alcohol to minors is forbidden. Any customer ordering wine from Château de Ferrand therefore undertakes to be 18 years of age at the time of the order. Consumption of alcoholic beverages during pregnancy can have serious consequences on the health of the child.

Applicable legislation and jurisdiction: In the event of any difficulties arising for the application of the present G.T.C.S. the parties shall seek to find an amicable solution in all good faith. The customer is urged to contact Château de Ferrand by telephone. In the event of negotiations proving to be unsuccessful, the present contract is subject to French legislation. Any dispute arising within the framework of the performance or construction of the present contract shall be brought before the jurisdiction of the head office of the vendor.
